2.1   THE TYPE OF PERSONAL INFORMATION WE COLLECT:

We currently collect and process data which includes the following information: personal details, physical addresses and telephone numbers (including mobile phone numbers), fax, email addresses, certified email addresses and, in general, the information necessary for the performance of any agreement we may have with you, such as bank account details, Company registration details, tax and VAT identification data, details obtained for credit ratings checks, and the data relating to the payment receipt system or any legal or commercial agreement purposes.

We can also process the following data concerning the personnel of suppliers/contractors/sub-contractors: the company they belong to, position held, data related to the suitability to carry out certain activities/tasks; In this case the supplier/contractor, as Data Controller, guarantees that the data is acquired and disclosed to Us in compliance with the legal standards and obligations concerning personal data processing.

  • How we collect personal information

The processed data is collected directly from you or via third parties, such as public data bases, trade registers and the internet, and may include:

  • Personal identifiers, contacts and characteristics (for example, name and contact details)
  • When you visit a Mondottica website, we may also collect certain data through the use of “cookies” and other automated means. Cookies are small pieces of data that are stored by your browser on your computer’s hard drive. We use cookies to gather data about the visitors to our websites, to enable us to improve our websites and deliver a better and more personalised service.
  • Data provided voluntarily by You: The optional, express and voluntary sending of messages or requests to the addresses indicated on our website, or the filling-in of any contact form, will result in the subsequent acquisition of the address of the sender, which is required in order to respond to any requests, as well as any other personal data included in the message. After the time of first contact we may ask You for additional personal data; this will be restricted to the data necessary to respond to your requests and to set up and perform contractual agreements and related obligations.

2.3   LEGAL REASONS FOR PROCESSING YOUR DATA

Mondottica will process personal, identification and non-sensitive data (for example but not limited to: name, surname, company name, address, telephone number and email address) provided by You, either through our website, by phone, e-mail, face to face or otherwise, and that we have subsequently acquired, without the need for your express consent.

What we process data for: Legal reasons
To manage communication with You and your requests, and if necessary, to communicate Your data to third parties for the sole purpose of responding to your request. Performance of an agreement, contractual or pre-contractual measures

To exercise our rights as a Data Controller, for example, the exercising of a right in court.

To send information notices, or promotional materials for example: If you are already one of our clients, we may send you information on our products and services similar to those that you have already used, unless you disagree.

For our legitimate business interests
To fulfil obligations laid down by the law, a regulation, Community legislation or an order from the Authorities; For legal reasons

We may analyse and process the Data on your consumer choices, through automated means, to analytically predict your purchasing preferences, to customise your experience with us, and to improve our offering to you, for example via communications and targeted campaigns. The data collected for this purpose will be stored until you withdraw your consent.

2.4   HOW WE PROCESS AND STORE YOUR PERSONAL INFORMATION

Data will be processed properly and lawfully in a relevant manner that is not excessive. We will use electronic and paper methods and take all reasonable steps to ensure the confidentiality and integrity of the data.

Mondottica will identify people authorized to process data, and Data will be made known to such persons, who in the performance of their duties will carry out the activities to provide the product or service requested.

Without the need for express consent, your data may be disclosed following inspections or checks (if required of us) to any organization or body fulfilling a legal obligation.

Your data may also be communicated to:

  • companies/professional firms that work with or provide consultancy services to us, for accounting, administration, taxation, law, fiscal matters and finance,
  • public administrations for the performance of duties within the limits established by the law or by regulations.
  • third party service providers to whom the data must be communicated for the fulfilment of contractual obligations.

Finally, your data can be provided to Licensors in order to fulfil the obligations laid down in the License Agreements, and if Mondottica distributes products purchased from third parties; to the third parties in question (in order to fulfil the obligations stated within the related distribution agreements).

Apart from that specified for browsing data, You are free to provide or not provide your personal data, and the provision of the data is not mandatory.

Any possible refusal to provide us with this data, or the incorrect/incomplete communication of any of the data, may render it impossible for us to meet your request, or to guarantee the consistency of the processing.

The provision of personal data for marketing purposes is optional.

Your information is stored securely at a Mondottica site, or within an IT system secured by Mondottica, using appropriate encryption and multi-factor authentication methods.

Personal data will be processed for the time necessary to fulfil contractual obligations and other obligations laid down in the laws applicable to our business and will be stored:

  • for the time necessary to fulfil the obligations stated in this information notice and in any event for a period of no longer than 10 years from the completion of the requested activities, as required by the laws in force.
  • in the case of data provided for marketing purposes, until the communication of the opt-out.
  • We keep any personal information of a financial nature for 6 years and then dispose of your information in a process that destroys confidential waste.

4.5 YOUR DATA PROTECTION RIGHTS:

 Under data protection law, you have rights including:

  • Your right of access – You have the right to ask us for copies of your personal information.
  • Your right to rectification – You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
